Rental Agreement

This Rental Agreement ("Agreement") automatically forms between the Owner and the Renter when a booking is confirmed on Nextdoorly. Nextdoorly is not a party to this Agreement; it is a contract directly between the two users. This Agreement is read together with our Terms & Conditions, Community Standards and Cancellation & Refunds Policy.
1. The rental
- The Owner agrees to lend the listed item ("Item") to the Renter for the booked period
- The Renter agrees to pay the agreed price, deposit (if any) and any delivery fee
- Title to the Item remains with the Owner at all times
2. Handover and condition checks
At handover, both parties should:
- Inspect the Item together (or document its condition with photos if delivered)
- Confirm any accessories, manuals or safety equipment included
- Note any pre-existing damage or wear
Failure to document the condition at handover means the Item is presumed to have been delivered in good working order.
3. Renter's responsibilities
- Use the Item only for its intended purpose and in accordance with any instructions or safety guidance provided
- Take reasonable care of the Item; do not modify, repair or sub-let it
- Comply with all applicable laws, including health & safety and licensing requirements
- Return the Item on or before the agreed end date in the same condition as received (fair wear and tear excepted)
- Notify the Owner promptly of any damage, fault or loss
4. Owner's responsibilities
- Provide an accurate listing description and photos
- Ensure the Item is safe, fit for the purpose described and (where applicable) compliant with any relevant safety standards
- Make the Item available for collection or delivery as agreed
- Provide reasonable instructions and any required safety equipment
- Hold appropriate insurance where their use of the Platform is in the course of a business
5. Late returns
If the Renter returns the Item late, the Renter shall pay the Owner the daily rate for each additional day (or part day) until the Item is returned, plus any reasonable losses caused by the delay. The Owner may report a non-return to Nextdoorly after 24 hours overdue.
6. Damage, loss and theft
- The Renter is responsible for damage to or loss of the Item beyond fair wear and tear during the rental period
- The Renter must report damage, loss or theft to the Owner within 24 hours of discovery
- The Owner may retain all or part of the deposit (if any) to cover the cost of repair or replacement, supported by reasonable evidence
- Where the cost of damage exceeds the deposit, the Renter remains liable to the Owner for the balance
- Theft must also be reported to the police and a crime reference number provided
7. Cleaning
The Item must be returned in a reasonably clean condition. Owners may charge a reasonable cleaning fee where this is not done.
8. Cancellation
Cancellation rights and refunds are governed by our Cancellation & Refunds Policy.
9. Disputes
The parties shall first attempt to resolve any dispute directly through the Nextdoorly messaging system. If they cannot, either party may ask Nextdoorly to assist as a neutral mediator. Nextdoorly's role is limited and entirely voluntary; we do not make legally binding decisions and may decline to intervene. Any unresolved dispute remains a matter between the Owner and the Renter and is governed by the laws of England and Wales.
10. Liability between users
Each party agrees that, to the fullest extent permitted by law, neither party shall be liable to the other for indirect or consequential loss. Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, fraud, or anything that cannot be excluded by law.
11. Nextdoorly's role
Nextdoorly provides the technology, payment processing and communication tools but is not a party to this Agreement and gives no warranty about the Item or the other user. Nextdoorly's liability is limited as set out in the Terms & Conditions.
12. Governing law
This Agreement is governed by the laws of England and Wales and subject to the jurisdiction of its courts.
